Can i file an i130 if my husband is in deportation?

my story is difficult i think. i am married to a LPR he got into some trouble and in 2004 won a cancellation of removal on appeal. ok well he once again got in trouble (felon possesion of a firearm) to make a long story short it wasnt his but the other guy got away and showed up at criminal court to confess it was his. my man after pleading not guilty was offered if he took a deal of 365 days in county he would be released that weekend, so without thiking he took it! my question is right now he is in deportation proceedings. he cant do another cancellation of removal as we already know. but i was told to do an i130. what do i have to fill out with that form? do i have to do an adjustment of status if he is already a LPR in proceedings? please help i dont want to lose him.i am an american citizen
