Am i Covered under my Auto Gap Insurance?

I was in a car accident and my car is being considered totaled. I have a car with a nada value of $13,000 but i had to file the Magnus moss warranty act against the manufacture for mechanical defects they couldn’t pay and they settled with me what the deprecated value of my would be which was $4,750.00. My auto insurance found this out and said my car was worth $8200 and they are going to total at this price. I still owe $16,500 on my car. Will Gap insurance pay from the $13,000 to my car pay off. Or will they pay the Cash value the ins said my car was worth. from $8,200 to pay off?
